In this week’s installation of The Grokster Chronicles, I will explain how the Grokster case is really just a modern day revisiting of the principles of the historical Betamax case. The “Betamax” case refers to Universal vs. Sony, in which the Supreme Court decided that a company was not liable for creating a technology that some customers may use for copyright infringing purposes, so long as the technology is capable of substantial non-infringing uses. Said another way, the court decided that, when a technology has many uses, the public cannot be denied the lawful uses just because some (or many or most) may use the product to infringe copyrights. Show notes

The non ABC, big three broadcasters have inked deals with comcast and directTV to supply content for $.99 to those pipe customers with digital video boxes connected to their TVs… hmm. Also, Apple seems to have submitted a patent to manage a system with a primary OS (OS X) and a secondary OS (Windows or Linux). dig it out here:

This week, I shut up for a minute, and let some great music do the talking. All the tracks featured this week are available on Wired’s CC Sampling CD, available at http://creativecommons.org/wired/

Starting next show, when I go back to yapping about Copyright Law, I’ll also provide a “music only” version of the show, without all the yapping. (Yes, I’m going to go back to my old shows and create “music only” versions of those, too.)

So I did a little dance mix on these tracks. Everything is available under a
Creative Commons Sampling Plus License. I’ve also listed the Record Labels for each artist, because I want to draw attention to any record labels that are progressive enough to allow their artists to release a track under this license.
